Terms of Service and Refund Policy

These Terms are an agreement between you and SMCI Media LLC, a Florida limited liability company, which operates MyHeadhunter at myheadhunter.online. In these Terms, "we" and "us" mean SMCI Media LLC.
1. The service
MyHeadhunter builds a job search for you. You tell us the work you want, where, and what to avoid. We find the job boards and employer career pages that list that work, set up a search that reads them every morning, and give you a private page of the open jobs that match, with an email of the new ones daily or weekly, as you choose. The subscriber ("you") is the person who places the order.
Your subscription includes one search. We list jobs that employers and job boards publish; we do not write the listings, we do not apply to jobs for you, and we do not guarantee interviews, offers, or employment. A listing may close, change, or be removed by its publisher at any time, so always confirm the details on the employer's own page before you apply.
2. Billing and automatic renewal
MyHeadhunter is a recurring subscription billed automatically to the card on file. On the day you sign up you are charged a one-time setup fee of $150 plus the first month at $50. After that you are charged $50 on the same day every month until you cancel. If you sign up on a day a later month does not have, such as the 31st, that month's charge falls on its last day.
Prices are stated on the sign-up page and at checkout. If the price changes, we will give you at least 30 days notice by email before the new price applies, and you may cancel before it takes effect.
If a charge fails, we notify you by email and Stripe retries the payment automatically. If payment cannot be collected after those retries, your search and emails pause until the card on file is updated.
Payments are processed by Stripe. We do not see or store your card number.
3. Cancellation and refunds
You may cancel at any time online: sign in, open Settings, and click Manage billing or cancel, or go to myheadhunter.online/billing and sign in with the email address you paid with. You may also cancel by replying to any email from us.
Cancellation takes effect at the end of the month you have paid for. Your search and emails continue until then, and no further charge is made.
Payments already made, including the setup fee, are not refunded, in whole or in part, except where required by law or as provided in section 7. Cancellation stops future charges.
4. What you own, and what we own
The details you give us about yourself and the work you want, and your saved job lists, are yours. You grant us permission to store and use them solely as necessary to provide the service to you.
The MyHeadhunter software, the searches we build, and the way they read job boards are the property of SMCI Media LLC. Your subscription grants you the right to use your search while the subscription remains active, and no other right. You may not copy, resell, or reverse engineer it. Job listings belong to the employers and job boards that publish them.
5. Acceptable use
The service is for your own job search. You may not share your account, resell the job lists, use the service to collect information about other people, or attempt to disrupt, overload, or reverse engineer it. We may suspend accounts that abuse the service, its users, or the job boards it reads.
6. Your responsibilities
You represent that the information you give us is accurate and that you are at least 16 years old. You are responsible for your own job applications, for checking each listing with its employer, and for keeping your sign-in email address secure.
7. Suspension and termination
We may suspend or close an account that breaches these Terms, fails to pay, or endangers others.
If we close your account for any other reason, we will refund the unused portion of any month you have paid for.
We may change, add, or retire features. If we discontinue the service entirely, we will give you at least 30 days notice by email, refund any unused paid period, and provide you an opportunity to export your saved job lists first.
8. Warranties and limitation of liability
We work to keep the service available and the job lists complete and current, but no software is free of defects, and job boards change without notice. The service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including the warranties of merchantability, fitness for a particular purpose, and non-infringement, and we do not warrant that the service will be uninterrupted or without errors, or that it will find every job. We look for every publicly available listing we can, but we may not reach every site.
To the fullest extent permitted by law, our total liability for any claim related to the service is limited to the subscription fees you paid us in the 12 months before the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, wages, opportunities, or data.
9. Indemnification
If a third party, including an employer, a job board, or a government body, brings a claim against SMCI Media LLC arising from your use of the service or your breach of these Terms, you will defend SMCI Media LLC and cover the resulting losses, costs, and reasonable attorneys' fees.
10. Disputes
These Terms are governed by the laws of the State of Florida, USA.
Any dispute will be heard only in the state or federal courts located in Pinellas County, Florida, and both parties consent to the jurisdiction of those courts. Either party may bring a qualifying claim in small claims court.
Claims must be brought individually, and not as part of a class or group action. To the fullest extent permitted by law, both parties waive the right to a trial by jury.
11. General
These Terms, together with our privacy policy, constitute the entire agreement between the parties concerning the service.
You agree that we may give notice by email to the address you signed up with.
We may assign these Terms to a successor operator of the service, for example in a sale or reorganization. You may not assign your account without our written consent.
Neither party is liable for delay caused by events beyond reasonable control, including provider outages, job board changes, natural disasters, or war.
A failure to enforce any provision of these Terms is not a waiver of the right to enforce it later. If any provision is found unenforceable, the remainder stands.
We may update these Terms. Material changes will be notified to you by email in advance.
